Wareham man arrested in Marion, found with guns and drugs
A Wareham man was arrested in Marion after authorities found him passed out in a car with guns, drugs and open alcohol containers.
Brian M. Ewan, 67, was arrested Saturday, Oct. 4 at Cumberland Farms in Marion and charged with possession of a firearm without a firearms identification card, possession of ammunition without a firearms identification card, carrying a firearm without a license, possession of a sawed-off shotgun, possession of a Class B drug, operating under the influence of liquor, possession of an open container of alcohol in a motor vehicle and no inspection/sticker.
Ewan was also charged with possession of a large-capacity feeding device, or, a magazine that can hold more than 10 rounds of ammunition.
According to a Marion Police report, Officer Patrick Adams found Ewan in the driver’s seat of his vehicle with keys in the ignition and several open alcohol containers at approximately 3:34 p.m. Adams was joined by Marion Detective Scott Smith in the investigation.
According to the report, Ewan denied that he had been drinking, he claimed he was looking at a scratch-off ticket.
Smith noticed a bulge on Ewan’s waistband consistent with a firearm. As Smith attempted to search Ewan, a struggle ensued and Smith gained control of Ewan's, Taurus G3C 9mm handgun with eight rounds of ammunition loaded inside according to the report..
Sargent Cardoso of the Marion Police Department informed Smith that Ewan's License to Carry, the permit required to purchase, possess and transport most firearms, had expired in 2000.
Further search found loose .22 caliber bullets on Ewan’s person and a clear bag containing a white powdery substance later positively identified as cocaine.
Also recovered was a sawed-off Mossberg 12-gauge shotgun with no ammunition. A shotgun with a barrel length that is less than 18 inches Massachusetts is considered sawed-off— Ewan's was just over 14-and-a-half inches long.
Police also found an opened 75 liter bottle of Jack Daniels, a 375 milliliter container of Jack Daniels and a can of Pabst Blue Ribbon beer.
This is not Ewan's first run-in with the law. He was arrested in 2020 after shooting another man in the face with a BB gun. He was found guilty in 2024 of; possession of dangerous weapon, assault and battery, possession of a firearm without a Firearms Identification Card and resisting arrest.
Ewan is on probation for those offenses until Dec. 19, 2025.
