TOWN MEETING ARTICLES TO AMEND TOWN OF WAREHAM ZONING BY-LAWS

Amending the Wareham Village WV-1 District by adding a new sub-district for redevelopment with new descriptions, density, use options, parking, and design guidelines.

Amending Section 386 and Table 320 for all commercial drive-throughs, and by expanding the use to the Strip Commercial CS District, as allowed by Special Permit.

Amending the setback for cannabis testing labs to eliminate the State setback restriction for schools

Amending section 340.4, to clarify the definitions of multi-family dwellings
Amending Signs Article 11, redrafted following the recommendation of the State Attorney General’s office.

Amending Article 420 and Article 222, replace Flood Plain Overlay District with State mandated text

Amending Article 3 Section 390, new Article 393.1, limit on marijuana delivery establishments

Add a new Article 4, Section 470, Storm Water Pollution Prevention

Amend Article 8 to add a Local Initiative Program for affordable housing

In accordance with Chapter 40 Section 32 of the General Laws of the Commonwealth of Massachusetts, this bulletin contains the General By-law Amendment adopted at the Annual Fall Town Meeting convened on December 12, 2020, Articles 22 & 23 approved by Assistant Attorney General Kelli E. Gunagan on March 19, 2021.

Claims of invalidity by reason of any defect in the procedure of adoption of amendment of this by-law only must be made within ninety (90) days of the date of posting.

ARTICLE 22 - ESTABLISH SOLID WASTE AND RECYCLING FEE
Motion made and seconded for Town to establish a solid waste by-law by creating Division XIII and inserting the by-law language in Appendix A of the Administration Handout.
