ADVERTISEMENT FOR BIDS

Leonard C. Lopes Memorial Park Improvements Project

Sealed bids for construction of the Leonard C. Lopes Memorial Park Improvements Project will be received by the Town of Wareham Town Administrator at the Wareham Memorial Town Hall, Town Administrator’s  Office, 54 Marion Road, Wareham Massachusetts 02751 until 1:00 PM prevailing time, Wednesday, December 18, 2024.   Bids submitted after this time will not be accepted. Bids will be opened and publicly read aloud at 1:30 PM prevailing time, Wednesday, December 18, 2024 in Room 27 at the Wareham Memorial Town Hall.

All bidders will be notified of the apparent low bidder. All bidding procedures will be in  accordance with the Massachusetts General Laws Chapter 30, Section 39M inclusive as amended.

The work under this Contract consists of improvements in the Town of Wareham. The     limits of work include:

  • Construction of the Leonard C. Lopes Memorial Park Improvements Project.

The contractor shall furnish all materials, labor, supervision, and equipment to perform all work shown on the plans consisting of, but not limited to, site preparation, removal of existing material, installation of a new parking lot and concrete sidewalk, installation of approximately 1,200 linear feet of 5 foot wide pervious stonedust walkways, paint two basketball courts, resurfacing a baseball diamond, loaming and seeding disturbed areas.  Demolition of the existing playground and installation of new playground equipment will be performed by others.  The contractor awarded this contract will be responsible for coordinating all of the work included in this contract with the Wareham Municipal Maintenance Department and the playground equipment contractor.

There will be no pre-bid conference.  Questions and comments shall be completed in accordance    with the Instructions to Bidders

The Project value is estimated to be $100,000. Prevailing Wages, as determined under M.G.L. c. 149, § 26-27H shall apply on this project. Materials, equipment and supplies used on this project       are exempt from sales tax to the extent provided by M.G.L. c. 64H, § 6(f). The Project is expected to commence on or about February 17, 2025 and be substantially complete no later than June 6, 2025. The project shall be fully completed by June 20, 2025.  Time is of the essence for the completion of this project.

Bid Documents, including Details and Specifications for the proposed work, may be obtained electronically on and after December 2, 2024. Bidders shall be pre-qualified by the Massachusetts Department of Transportation. Only bidders  pre-qualified by MassDOT may receive an official proposal format of the bidding documents.Official forms for Prequalification can be found at: https://www.mass.gov/prequalification-of- horizontal-construction-firms.

Bid Deposits shall be submitted in the amount of 5% of the bid price including any alternates. The Bid Deposit shall be made payable to the Town of Wareham and shall be in the form of a bid bond issued by a surety licensed to do business in the Commonwealth of Massachusetts; and shall be conditioned upon the faithful performance by the principal of the agreement contained in  the bid. The Town of Wareham reserves the right to reject or approve a surety. The Bid Deposits of the three (3) lowest responsible and eligible bidders shall be retained until the execution and delivery of the Contract.

The contract will be awarded to the bidder deemed by the Town of Wareham to be the lowest responsible and eligible bidder. Selection of the successful bidder will be based upon bidder     qualifications, including evidence of past performance on similar projects and bid price. The         Contract award is subject to the availability of funding.

The successful general bidder will be required to furnish a Performance Bond and a Labor and Materials Payment Bond, each of which shall be in the amount equal to one hundred percent (100%) of   the contract price. 

The Town of Wareham reserves the right to reject any bid which, in its judgment, fails to meet the requirements of this Advertisement for Bids or which is incomplete, conditional, or obscure, or which contains additions or irregularities, or in which errors occur in addition to the foregoing. The Town of Wareham also reserves the right to reject any and all proposals if it deems such rejection(s) to be in the best interest of the Town. The Town of Wareham further reserves the right to waive any minor discrepancies or informalities, to permit a bidder to clarify discrepancies or to conduct discussions with all qualified bidders in any manner necessary to serve the best interests of the Town. Any fees or other expenses of the bidders associated with this Advertisement for Bid process are solely the responsibility of the bidders.

No bidder may withdraw its bid within thirty (30) days (Saturdays, Sundays and Holidays excluded) after the date designated above for the opening of the bids. Any bid submitted will be binding for sixty (60) days after the time of bid opening.
