By virtue and in execution of the Power of Sale contained in a certain mortgage given by Napoleon N. Delgado to Bank of America, N.A., and now held by Avail 3 LLC, not in its individual capacity but solely as Administrator of Restoration III Trust, said mortgage dated March 8, 2010 and recorded in the Plymouth County Registry of Deeds in Book 38318, Page 96, said mortgage was assigned from Bank of America, N.A. to Nationstar Mortgage LLC by assignment dated November 8, 2012 and recorded with said Registry of Deeds in Book 42223, Page 138; said mortgage was assigned from Nationstar Mortgage LLC dba Champion Mortgage Company to Bank of America, N.A. by assignment dated August 27, 2015 and recorded with said Registry of Deeds in Book 46052, Page 327; said mortgage was assigned from Bank of America, N.A. to The Secretary of Housing and Urban Development by assignment dated January 21, 2016 and recorded with said Registry of Deeds in Book 46598, Page 1; said mortgage was assigned from The Secretary of Housing and Urban Development to Avail 3 LLC, not in its individual capacity but solely as Administrator of Restoration III Trust by assignment dated February 21, 2025 and recorded with said Registry of Deeds in Book 59843, Page 70; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on July 31, 2025 at 11:00 AM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:

The land in Wareham, Plymouth County, Massachusetts, in that part called East Wareham, and being Lot numbered forty-eight (48) as shown on that plan entitled “Pine Lake Shores, East Wareham, Mass., Owned by Prosperity Development Co., Revised Sept., 1948, by Francis E. Friberg, Surveyor, August, 1947”, which said plan is recorded with Plymouth County Registry of Deeds, in Plan Book 7, Page 533, more particularly bounded and described as follows:

On the SOUTHWEST: by Pine Lake Drive, Fifty-six and no/100 (56.0) feet, more or less;
On the NORTHWEST: by Lot #68 and #69, One hundred two and no/100 (102.0) feet, more or less;
On the NORTHEAST: by Lots #62 and part of Lot #63, Fifty-six and no/100 (56.0) feet, more or less;
On the SOUTHEAST: by Lot #49, One hundred and no/100 (100.0) feet.

Containing 5,600 square feet, more or less.

Together with all rights, privileges and easements connected therewith and subject to restrictions and conditions of record and are hereby conveyed subject to any building and zoning law requirements which may be in force and applicable.

The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.

TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.

FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer’s or cashier’s check at the time and place of the sale by the purchaser.
