In accordance with the provisions of M.G.L. Chapter 40A, Section 5, the Wareham Planning Board will hold a public hearing on September 8, 2025 at 6:00 PM at the Wareham Multi-Service Building, Room 520, 48 Marion Road, Wareham, MA 02571 to consider proposed amendments to the Wareham Zoning Bylaw in order to bring the bylaw into compliance with the requirements of M.G.L. Chapter 40A, Section 3A, also known as the MBTA Communities Zoning Law.
Summary of Proposed Amendments
The proposed zoning amendments are intended to comply with the State’s requirements for multi-family zoning in MBTA-adjacent communities. The revisions include, but are not limited to:
Present and make changes to the Commercial General district;
Permitting multi-family housing as-of-right within the Commercial General district;
Establishing dimensional and density requirements consistent with Section 3A guidelines;
Modifying definitions and procedures related to multi-family residents;

Public notice is hereby given of the Waterways application by Jeff and Renee Hunt to construct and maintain a seawall at 80 Pinehurst Drive in the municipality of Wareham, in and over the waters of the Wareham River. The proposed project has been determined to be water-dependent.
The Department will consider all written comments on this Waterways application received within 30 days subsequent to the “Notification Date”. Failure of any aggrieved person or group of ten citizens or more, with at least five of the ten residents residing in the municipality(s) in which the license or permitted activity is located, to submit written comments to the Waterways Regulation Program by the Public Comments Deadline will result in the waiver of any right to an adjudicatory hearing in accordance with 310 CMR 9.13(4)(c).

Summary of Proposed Zoning Amendments – Contractor Bays
1, Article II–Definitions
Add two new definitions:
Contractor Bay: A small, nonresidential tenant space (typically under 5,000 sq. ft. GFA) designed for trade contractors, with work and storage indoors, limited screened outdoor storage, and possible accessory office.
Contractor Yard: An establishment for larger-scale contractor operations with more extensive outdoor storage than allowed for a Contractor Bay.Article III – Table of Use Regulations
2. Insert “Contractor Bay” as a new use, allowed by Special Permit in certain commercial, industrial, and marine-related districts, and prohibited in residential districts. Add related footnotes regarding outdoor storage limits and screening.
3. Article XV – Site Plan Review & Special Permits
Create a new section establishing special permit standards for Contractor Bays, including:
All activities within enclosed buildings.
Limits on outdoor storage (max. 10% lot area or 2,500 sq. ft.), location, and screening requirements.
Controls on noise, lighting, hours of operation, vehicle queuing, hazardous materials handling, and Stormwater management.
Design standards to minimize impacts on abutters.
Required findings and conditions for permit approval.
4 Article VI – Off-Street Parking & Loading
Add specific parking and loading requirements for Contractor Bays based on floor area, office space, and company vehicles.
5. Housekeeping Changes
Update indices, sign regulations, and the fee schedule to reflect the new use.
