ARTICLE – AMEND TOWN OF WAREHAM ZONING BY-LAWS FOR AFFORDABLE HOUSING UNDER THE LOCAL INITIATIVE PROGRAM

To see if Town Meeting will vote to amend Article 830 and 840 of the Wareham Zoning By-laws for affordable housing under the State’s Local Initiative Program with the version of Article 830 and 840 on file with the Town Clerk and the Planning Office or to take any action relative thereto.

ARTICLE – AMEND TOWN OF WAREHAM ZONING BY-LAWS FOR SOLAR ENERGY GENERATION FACILITIES

To see if the Town will vote to delete Article 5 Section 590 of the Wareham Zoning By-Laws in its entirety and to replace it with the version of the Article 5 Section 590 Solar Energy Generation Facilities bylaw as presented and to make revisions as presented to Article 3 Section 320 Use Table and Article 16 Definitions of the Wareham Zoning By-Laws as necessary and related to Article 5 Section 590 or to take any action relative thereto.

To see if Town Meeting will vote to add a new section 470 calling for reduction of Phosphorus and Total Suspended Solids in stormwater runoff from developed sites.

Request for Release of Funds
To all interested agencies, groups, and persons:

On or about March 18, 2022, the Town of Wareham will submit a request to the Massachusetts Department of Housing and Community Development (DHCD) for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), as amended, to undertake a project known as: FY 2021 Wareham Mini-Entitlement Plan Grant, consisting of the following project activities:

Public Social Services: Funding to three agencies; Funding: $165,000 from CDBG funds.

Planning Study: Complete an engineering study to determine the integrity of 195 Main Street in Wareham; Funding: $25,000 from CDBG funds.

The activities cited aboveare exempt from review under 24 CFR part 58.34(a).

The grant will also consist of one activity that is categorically excluded under 24 CFR Part 58.35(a)(1):

Onset Highland Avenue Sidewalks Replacement*:Reconstruct approximately 700 linear feet of sidewalk along Highland Avenue in Onset Village; Funding: $415,000 from CDBG.

*The proposed activity listed above is categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Department of Planning and Community Development, Town Hall, 54 Marion Road, Wareham, MA 02571 and may be examined or copied Monday through Thursday, 8:30 A.M. to 5:00 P.M.
Public Comments
Any individual, group or agency may submit written comments on the ERR to the Department of Planning and Community Development. All comments received by March 17, 2022, will be considered by the Town of Wareham prior to authorizing submission of a request for release of funds.
Release of Funds
The Town of Wareham certifies to DHCD that Derek Sullivan, in his capacity as the Town Administrator/Environmental Certifying Officer for the Town of Wareham, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. DHCD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Town of Wareham to use Program funds.

Objections to Release of Funds
DHCD will accept objections to its release of funds and the Town of Wareham’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Town of Wareham; (b) the Town of Wareham has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by DHCD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to MA Department of Housing and Community Development, Division of Community Services, 100 Cambridge Street, Suite 300, Boston, MA 02114. Potential objectors should contact the Massachusetts Department of Housing and Community Development to verify the actual last day of the objection period.
